UAE Visa and Immigration

If you are employed by a mainland company in Dubai and your employment is terminated or you resign, your employer must first cancel your work permit and residency visa. This process is governed by UAE employment and immigration laws.

Work Permit Cancellation Process

In the UAE, an employer is required to cancel the employee's work permit once employment ends — provided both parties have fulfilled their legal obligations.

Employee Rights & Employer Responsibilities During Cancellation

When an employment contract ends in the UAE, cancelling the work permit is a legally regulated process designed to protect both the employer and the employee. The cancellation can only proceed once all contractual and statutory obligations are fulfilled.

Before the work permit is cancelled, the employer must:

  • Settle all pending salary payments
  • Pay end-of-service benefits (if applicable)
  • Clear payment for unused annual leave
  • Cancel the labour card and residency visa
  • Provide official cancellation confirmation
📜 Governing Regulations
Cabinet Resolution No. 1 of 2022
Federal Decree Law No. 33 of 2021

The employer is also required to obtain written acknowledgement confirming that all employee entitlements have been settled before final approval of the work permit cancellation.

According to Article 7(3) of Cabinet Resolution No. 1 of 2022, the employer must complete the following:

1
Submit a cancellation application through the Ministry of Human Resources and Emiratisation (MOHRE) channels
2
Complete all required documentation
3
Pay any outstanding fines (if applicable)
4
Confirm that all employee entitlements have been settled
5
Comply with any additional ministerial requirements

Only after this process is completed will the residency visa be cancelled.

Grace Period After Visa Cancellation

Once your UAE residency visa is cancelled, you are allowed to remain in the country during the grace period mentioned on your visa cancellation document.

During this period, you must either exit the UAE or change your visa status legally.

What Happens If You Overstay?

⚠️
Important Warning - Article 11, Federal Decree Law No. 29 of 2021
If an individual does not renew, change status, or leave the UAE within the permitted grace period, administrative fines will be imposed for each day of illegal stay. Overstaying may also negatively impact future visa applications.

How Can You Legally Stay in the UAE?

💼

Secure a New Job

If you secure a new job during the grace period, your new employer can apply for a new work permit. Your residency status can be changed while you remain inside the UAE.

✈️

Apply for Tourist/Visit Visa

Alternatively, you may apply for a visit or tourist visa (subject to approval) to extend your stay legally.
