UAE Labour Law 2026
A comprehensive guide to understanding UAE Mainland Employment Law and employee rights during the probation period
Understanding UAE labour laws is essential for both employers and employees. Whether you're a business owner managing HR compliance or an employee navigating your rights, knowing the legal framework protects everyone involved.
This guide breaks down the latest rules under UAE Employment Law regarding termination during probation periods.
Can an employer terminate an employee during the probation period?
— but only under specific legal conditions outlined in Federal Decree-Law No. 33 of 2021
Article 9(1) of Federal Decree-Law No. 33 of 2021
Regarding the Regulation of Employment Relationships
The probation period must not exceed six months from the date of joining
The employer may terminate the employee during probation for valid reasons
The employer must provide at least 14 days' prior written notice
Verbal notice is not legally sufficient — all termination notices must be documented in writing.
Even during probation, the employer is legally required to settle all dues up to the employee's last working day.
Article 29(3) of the UAE Employment Law
Mandatory payments upon termination
Full payment for all days worked up to the last working day
Compensation for the 14-day notice period if not served
Accrued annual leave compensation (if applicable)
After termination, the employee has the right to request an Experience Certificate. Under Article 13(11) of the Employment Law, the employer must provide — free of charge — a certificate containing:
The certificate must not include any statement that damages the employee's reputation or affects future employment.
Probation period cannot exceed six months from joining date
14 days written notice is mandatory for termination
All dues must be completely settled on the last day
Experience certificate must be issued upon employee request
With UAE labour regulations becoming more structured and employee-focused, businesses must ensure HR practices align with federal laws. Failure to comply may result in legal disputes or penalties.
